In United States v. Alvarez-Bernabe, the Court affirmed the district court’s sentence. Petitioner illegally reentered the United States after being deported for committing an aggravated felony; the district court sentenced him to 57 months imprisonment and 3 years supervised release, which Petitioner claims is unreasonable. The Court disagreed, finding the the district court appropriately considered the fact that Petitioner was deported and reentered the United States twice prior as well as the statutory sentencing guidelines and factors when determining the ultimate sentence.
