The Denver County Court will be closed Monday, March 28, in observance of the Cesar Chavez holiday, and Friday, April 1, for a previously-announced, budget-required furlough day for City employees. Friday is the second of five planned furlough days this year.
The state-operated Denver District Court, Juvenile Court, and Probate Court will be open both days.

At the end of last week, thirteen more bills reached Governor John Hickenlooper’s desk and were signed into law. They comprised of the seventh group and eighth group of bills to emerge from the 2011 General Assembly.

The Tenth Circuit on Friday issued one published opinion and six unpublished opinions.

In United States v. Begaye, the Court affirmed the district court’s decision and sentence. Petitioner plead guilty to aggravated sexual abuse of his eleven-year-old daughter; he alleges that the district court inappropriately increased his sentence based on the “extreme psychological injury” to his victim, as well as his “extreme conduct,” under the United States Sentencing Guidelines Manual, and failed to adequately give its reasons for the increase. However, the Court concluded that it should not remand as it is satisfied that the district court would impose the same, reasonable sentence if it did, and doing so to make a “finding of fact regarding the ‘normal’ level of psychological injury suffered by victims of aggravated sexual assault” would be an empty exercise. Additionally, nothing in the language of the guidelines “compels a district court to first establish the ‘typical’ perpetrator offense conduct for this crime,” to be compared to the conduct of the Petitioner, before increasing the sentence. Also, under plain error review, Petitioner was unable to show that the alleged lack of explanation concerning the sentence increase effected his substantial rights.
