New Phone Numbers for Tenth Circuit Case Management Teams

As of July 7, the case management teams at the Tenth Circuit Court of Appeals have new telephone numbers.

To contact staff regarding appellate matters in Colorado and Oklahoma, and Agency matters, the new contact number is (303) 335-2729.

The new contact number for appellate matters in Kansas, New Mexico, Utah, and Wyoming, as well as Tax matters, is (303) 335-2728.

Tenth Circuit: Opinions, 7/7/10

The Tenth Circuit on Wednesday issued one published opinion and six unpublished opinions.


In Forest Guardians v. United States Fish and Wildlife Service, the Court affirmed the district court’s decision to uphold the United States Fish and Wildlife Service’s (FWS) decision to “reintroduce a nonessential experimental population” of falcons into southern New Mexico. FWS did not violate the Endangered Species Act by promulgating a final rule to release the captive-bred falcons “in an area that is not wholly separate geographically from an existing falcon population;” substantial evidence supported FWS’s conclusion that no wild falcon population would prevent the release of the captive-bred falcons in that area. Additionally, FWS did not violate NEPA through its release of the falcons before completing its environmental impact analysis; FWS took the required “hard look” at the environmental impacts of the decision.
