Tenth Circuit: Opinions, 8/5/10

The Tenth Circuit on Thursday issued one published opinion and two unpublished opinions.


In Flitton v. Primary Residential Mortgage, Inc., the Court affirmed the district court’s award of attorney’s fees to Respondent on prevailing in a Title VII claim against Petitioner. Although Respondent did not prevail on all of her claims, the substantial judgment in her favor allowed for the district court to reasonably impose attorney’s fees. Additionally, Respondent was properly denied appeal-related fees, as such fees must first be requested of the court.
